The complaint alleges, among other charges, that Promenade telemarketers signed up customers for a "free trial" without informing them that they would eventually be charged for continuation in the program and for renewal fees. The FTC also made substantial allegations about the defendant's financial practices.

Among other requirements, the defendants are currently bound by a stipulated order requiring them to obtain express informed consent from all new customers acquired through telemarketing.
