National Online Privacy Law a 'When,' Not an 'If' 
Between high-noon debt-ceiling standoffs and government shutdown threats, Congress has continued to seek consensus around a national online privacy law, sparked by the Federal Trade Commission's (FTC) 2010 preliminary report calling, among other things, for a "Do Not Track" ("DNT") option for consumers. Passage now is hardly assured as the 2012 election campaign gets underway, but given current bipartisan sponsorship and industry support of leading bills, eventual enactment seems to be a matter of when, not if.

Text Sweepstakes Settlement Illustrates Best Practices but Answers Few Questions  
The recent settlement of three California consumer class actions sheds light on several issues that sponsors and others involved in premium text message-based contests should consider when planning such promotions. In these contests, consumers pay a small fee each time they send an entry via text message. The suits alleged that such sweepstakes run in conjunction with popular television programs such as Deal or No Deal, American Idol, 1 vs. 100 and America’s Got Talent constituted illegal lotteries and violated state laws in Georgia, California, New York and Massachusetts.

FTC Brings First Health-Related Mobile Apps Cases 
The Federal Trade Commission (FTC) has expanded its look into the mobile application marketplace with the announcement of two recent actions against the developers of mobile software applications that were promoted for the treatment of acne. Upon enforcement, the settlement orders would bar both companies from making certain health-related claims without substantiation and would require each company to pay a fine. These cases are the first the FTC has brought targeting health claims in the mobile application marketplace.

Judge Agrees: Customer Dissatisfaction Does Not Equal False Advertising 
In a well-reasoned decision that should please advertisers everywhere, a federal district court judge in California has thrown out a class action case filed against Epson in which the plaintiffs had alleged that Epson should pay them millions of dollars in damages because its inkjet printers "guzzle" ink, something that they said Epson "should have disclosed" in its ads, but didn't.
