While Congress Takes Time Out on Internet Privacy, FTC Tackles the 'Four Horsemen' 
While the 2012 election is likely to stall congressional momentum on online privacy legislation, it isn't slowing down the Federal Trade Commission (FTC). Privacy has become one of its two main priorities, along with protection of the "Great Recession Consumer" from financial scams, according to FTC Chairman Jon Leibowitz. During the past several years, he recently told Congress, the FTC has brought more than 100 cases dealing with online privacy issues, including behavioral advertising, spyware and data security.

FTC Stomps on Reebok: Beware of Overhyped Health-Related Advertising Claims 
The Federal Trade Commission (FTC) recently announced that athletic shoemaker Reebok International Ltd. has agreed to settle charges that it deceptively advertised its "toning" shoes, which the company claimed would provide extra tone and strength to leg and buttock muscles. Reebok is required to pay $25 million for refunds to individuals who bought the Reebok EasyTone or RunTone toning shoes.

Nutella Case Another Example of California's Tough Class Action Laws 
As discussed in previous DRMA Voice articles, California has become a battleground state for consumer class action cases alleging false advertising. Unfortunately, due to changes in the law following a 2009 decision called Tobacco II, it seems marketers have fewer options available to them to successfully oppose the certification of such cases as class actions.
