Class Action Waivers Enforceable? California Court Says, ‘Not So Fast!’ 
Class actions against dietary supplement sellers. Text marketers. Biz-op providers. You name it, and a class action has disturbed the peace of many a direct response marketer in recent times. Nary a weight-loss supplement client of this attorney seems to have been spared. Financially unable or unwilling to go the distance, even where meritorious defenses exist, many targets of these suits have no choice but to pay the “ransom,” most of which goes to class attorney’s fees. As is so often the case in Federal Trade Commission (FTC) suits, the suing party has all the leverage.

California Attorney General Kamala Harris has engaged in a high-profile campaign to encourage advertisers to comply with California’s Online Privacy Protection Act that requires online businesses to develop privacy policies and display them.

FTC, POM Wonderful Battle Continues 
The Federal Trade Commission (FTC) has issued a final opinion and order affirming in large part the previous ruling by an administrative law judge after trial, that POM Wonderful LLC and other related parties violated the FTC Act by making false or misleading claims to promote their pomegranate products, POM Wonderful Juice, POMx Pills and POMx Liquid.

"When you go into Nordstrom, you're going to be treated like a millionaire. We want our clients to come in here and feel like they're special and unique."

Warren co-founded the Direct Response Marketing Alliance (DRMA) member company in 2009 with long-time friend and associate Reno Renaldo, who carries the title of executive vice president. The pair, who previously served together at a national performance-based media agency, is clearly at ease during an interview in their brand new office space.
