FCC Says On-Demand Text Messages Do Not Violate the TCPA 
A big win for retailers and others, the Federal Communications Commission (FCC) issued a Declaratory Ruling under the Telephone Consumer Protection Act (TCPA) on July 10 that will make it easier for companies to text consumers in response to consumer-initiated text messages.

FCC’s Declatory Ruling Addresses 21 TCPA Clarification Requests 
The Telephone Consumer Protection Act (TCPA) generally prohibits placing calls or sending text messages using an “automatic telephone dialing system” (ATDS) without the prior express consent of the called party. Given the high stakes in TCPA class actions ($500 to $1,500 per violation), litigants across the country have butted heads over the proper interpretation of key statutory provisions.

Motivational Fulfillment & Logistics Services, a company that combines direct response and 4PL retail distribution, acquires a new 502,000-square-foot cross-dock facility in Chino, Calif. It features 120 dock doors and 160 trailer stalls. The facility will be operational by Sept. 1.

Advertising agency Quigley-Simpson appoints Angela Zepeda as its chief executive officer. Founders Gerald Bagg and Renee Hill Young become the agency’s co-chairmen.

Brand DRTV advertising agency Atomic Direct wins Telly Awards for two of its outdoor product television spots: Mission Athletecare’s Multi-Cool and Lowe’s allen + roth custom outdoor patio furniture.

iYogi, a consumer tech support services brand, sets up its first North American global technology services center in Lewiston, Maine. Working with Argo Marketing Group as its delivery partner, the iYogi center will employ 300 people and will support the company’s product and services innovation strategy to address the opportunities arising from the rapid proliferation of computing and Internet of Things (IoT) devices.

The Jay Group, an outsourced solutions provider, announces that Blake Dudek as vice president of contact center services, Brad Weise as vice president of fulfillment services, and Dave Spendio as contact center operations manager.

a2b Fulfillment, a third-party provider of business support services, including warehousing, order fulfillment and customer care, announces the grand opening of its art studio in the Pete Nance Boys & Girls Club of Greensboro, Ga. Kre8 Media, a DRTV, digital media and brand advertising agency, promotes Eureka Vanterpool to the new position of senior vice president, operations. Vanterpool, formerly director of client services, will spearhead operations, human resources, information systems, traffic, new business coordination and agency promotion and communications.

Cannella Response Television announces that long-time executives Peggy Gobel and Michael Hennen have been named senior vice presidents. Both work at the company’s headquarters in Burlington, Wis.

Direct response agency R2C Group announces it has been selected as the TV creative and media agency for Blinds.com, the No. 1 online provider of blinds, shades, shutters, and draperies in the United States. The Portland, Ore.-based agency will handle TV brand strategy, TV creative, TV production, and broadcast media planning/buying.

Visaya Knowledge Process Outsourcing Corporation expands its Philippine-based contact center service delivery and back-office solutions for the direct response industry by adding new capacity to more than double its size.

Horizon Media introduces HorizonAdvanced, a new unit designed as a centralized vetting process to identify the value of new non-traditional TV platforms. Horizon said it will integrate its television innovation efforts with its national television activation team to spearhead innovation in the areas of advanced, programmatic and addressable TV buying.
