FCC Says On-Demand Text Messages Do Not Violate the TCPA 
A big win for retailers and others, the Federal Communications Commission (FCC) issued a Declaratory Ruling under the Telephone Consumer Protection Act (TCPA) on July 10 that will make it easier for companies to text consumers in response to consumer-initiated text messages.

FCC’s Declatory Ruling Addresses 21 TCPA Clarification Requests 
The Telephone Consumer Protection Act (TCPA) generally prohibits placing calls or sending text messages using an “automatic telephone dialing system” (ATDS) without the prior express consent of the called party. Given the high stakes in TCPA class actions ($500 to $1,500 per violation), litigants across the country have butted heads over the proper interpretation of key statutory provisions.

Motivational Fulfillment & Logistics Services, a company that combines direct response and 4PL retail distribution, acquires a new 502,000-square-foot cross-dock facility in Chino, Calif. It features 120 dock doors and 160 trailer stalls. The facility will be operational by Sept. 1.

iYogi, a consumer tech support services brand, sets up its first North American global technology services center in Lewiston, Maine. Cannella Response Television announces that long-time executives Peggy Gobel and Michael Hennen have been named senior vice presidents. Both work at the company’s headquarters in Burlington, Wis.

Visaya Knowledge Process Outsourcing Corporation expands its Philippine-based contact center service delivery and back-office solutions for the direct response industry by adding new capacity to more than double its size.

Horizon Media introduces HorizonAdvanced, a new unit designed as a centralized vetting process to identify the value of new non-traditional TV platforms.
